NEW LAW - Neighbors and Broken Fences, see you in court....

Adjoining Owners Equally Responsible for Shared Fences and Boundaries
Adjoining landowners, with properties contiguous or in contact with each another, must share equally the responsibility for maintaining boundaries and monuments between them. Adjoining landowners are presumed to share an equal benefit from any fence dividing their properties, and unless otherwise agreed in writing, are presumed to be equally responsible for the reasonable costs of construction, maintenance, or necessary replacement of the fence. A landowner must give each affected adjoining landowner a 30-day prior written notice of any intent to incur costs for a division fence. The notice of intent must include the following: (1) a notice of the presumption of equal responsibility for the reasonable costs of construction, maintenance, or necessary replacement of the fence; (2) a description of the nature of the problem with the shared fence; (3) the proposed solution for the problem; (4) the estimated construction or maintenance costs to address the problem; (5) the proposed cost sharing approach; and (6) the proposed timeline for addressing the problem. An adjoining landowner can overcome the presumption mentioned by demonstrating by a preponderance of the evidence that imposing equal responsibility would be unjust. To determine whether equal responsibility for the reasonable costs would be unjust, a court will consider the following: (1) whether the financial burden on one landowner is substantially disproportionate to the benefit conferred upon that landowner by the fence; (2) whether the cost of the fence would exceed the difference in the value of the property before and after its installation; (3) whether the financial burden to one landlord would impose an undue financial hardship given that party’s financial circumstances as demonstrated by reasonable proof; (4) the reasonableness of a particular construction or maintenance project, including the extent to which the costs appear to be unnecessary, excessive, or the result of one landowner’s personal aesthetic, architectural, or other preferences; and (5) any other equitable factors appropriate under the circumstances. This law does not apply to a city, county, political subdivision, public body, or public agency. Existing law enacted in 1872 which requires a homeowner who fully encloses a property to refund a neighbor a just proportion of the value of a division fence has been repealed.

Memorial Day Thoughts to My Two Fallen USMC Brothers

 
 
Memorial Day is a day to remember all those who paid the ultimate sacrifice for our country and us. During my years in the U.S. Marine Corps I had the honor to know Major Gannon and Major Mendoza. After I got out of the USMC I later found out that these two Devil Dogs were killed in action. These men were warriors and true American heroes. To them and to all the other American warriors I THANK YOU for your bravery and fearlessness, that it take to take up arms and defend our beautiful USA. THANK YOU and you will never be forgotten. RIP.

Mayor Indicted in Mortgage Fraud Scheme


AlfonsoGomezBroker.com - A mayor in the Miami area has been suspended by Florida Gov. Rick Scott following a federal indictment alleging mortgage fraud.

According to a report from the Miami Herald, North Miami Mayor Lucie Tondreau was suspended Tuesday after appearing in court to face charges related to her role in an $8 million fraud scheme.

In its indictment, the government alleges that Tondreau, working with accused co-conspirator Karl Oreste, advertised for a local mortgage company on her weekly radio show to in an effort to recruit straw borrowers whose identities and credit were used to purchase approximately 20 properties.

Officials estimate the scheme defrauded various mortgage lenders out of $8 million.
She faces charges of conspiracy to commit fraud and wire fraud affecting a financial institution.

Also named in the indictment are Okechukwu Josiah Odunna and Kelly Augustin, who also stand accused of recruiting borrowers and preparing false documents.

In remarks made to the press following the hearing, Tondreau maintained her innocence, saying she believes her community will support her.

Also speaking Tuesday was Tondreau's attorney, Ben Kuehne. "It appears that one of the individuals in this case was an advertiser on her radio program. We fail to see how that involves criminal conduct," he said, adding, "We're confident the facts will show that all she attempted to do is help her community lift themselves up."

More Home Owners Remodel to Raise Home’s Value


AlfonsoGomezBroker.com - Home owners are remodeling their homes to increase the value, but they also are showing more desire to stay and enjoy their remodels before they move on.
Fifty-three percent of U.S. home owners say they are remodeling to increase the resale value of their home, but they have no plans to move in the next five years, according to a new Houzz & Home survey of more than 135,000 respondents. Sixteen percent of remodelers say they plan to sell their home in the next two years.

One in five — or 22 percent — of the remodelers surveyed say they feel home prices are rising too quickly to consider moving yet. Twenty-four percent of respondents say they would prefer to move, but remodeling their home makes more economic sense.
The Millennial generation of home owners seem to be the most apt to move within the next five years, according to the survey. Thirty-six percent of them say they are remodeling to increase their home’s value with the intent to move to their next home soon.
Overall, the most popular renovation projects are bathroom remodels or additions and kitchen remodels. Home owners continue to devote the highest share of dollars to kitchen remodels, spending an average of $26,172.

That can vary drastically by region, however. Home owners in the Northeast and West tend to spend the most on their renovation projects at an average of $32,155 and $29,411, respectively, on their kitchens (compared to $23,946 in the Midwest and $21,894 in the South), according to the survey.
The most popular replacement projects are flooring/paneling/ceiling, followed by windows/doors and roofing.

The top challenges that home owners say they face when renovating are finding the right products, defining their style, making decisions with spouse/partner, and educating themselves.

10 Ways to Turn Off a Would-Be Homebuyer

Back in 2007, homebuyers would beg to purchase your house. They would even bid more than the asking price for the privilege to do so.

Today ... well, not so much. Once the real estate bubble burst and foreclosures poisoned the housing pool, buyers suddenly regained the upper hand. But instead of buying, they're waiting, convinced that housing prices will continue to drop.

What's a smart seller to do in this environment?

We assembled a coast-to-coast SWAT team to address the crisis: Chad Goldwasser of Goldwasser Real Estate in Austin, Texas; Terry Cannon, a buyer's agent and broker with Oregon Exclusive Buyers Realty in Salem, Ore.; and Julie Dana, the New York-based "home stylist" and co-author of "The Complete Idiot's Guide to Staging Your Home to Sell."

They suggest 10 buyer turnoffs that sellers should avoid at all costs.

"If you do all the staging correctly and have a good agent, the house will hopefully only be on the market a few weeks," Dana says. "Then you can go back to living your life."

1. Dirt

Hands down, our panel agrees: Nothing turns off a buyer quicker than a dirty house.

"The No. 1 biggest mistake is not getting the home in the best possible condition. That's huge," says Goldwasser. "I won't even represent sellers at this point unless they are fully aware of how important it is to get their home in the absolute best condition that they've ever had it in."

Goldwasser recommends that sellers go the extra mile, from steam-cleaning tile and grout to replacing carpets.

"If the carpets are old and smelly, you should put in new," he says. "If they're relatively new, you should at least have them shampooed."

Cannon agrees that grime can derail any showing.

"The home should be neat and clean and free of all debris," Cannon says. "If it reeks of cats or the kitchen sinks and counters are so filthy that it almost looks like the food is moving, I won't even want to come in."

2. Odors

Buyers, it's said, buy with their noses. Make sure your home smells fresh and inviting.

"Odors are a big one, especially kitchen odors," says Dana. "I advise my clients not to cook fried food, fish or greasy food while the house is on the market."

Some pet owners mistakenly believe pet smells to which they've become accustomed help make their abode homey. Nothing could be further from the truth.

"If you're a dog person, you tend to think everyone else is a dog person," says Goldwasser. "But the truth is, 50 percent of the population hates dogs and doesn't want to be near them. "Pets in the home? You have to deal with that."

Dana advises her clients to eliminate all traces of pets, not just pet odors. It's important to get rid of pet paraphernalia and have a "pet plan" to make sure the animals are not around when the house is shown.
"Pets in the home? You have to deal with that."

"A lot of times, people will leave pet items out -- dog dishes, cat litter boxes, etc.," Dana says. "That immediately turns off a buyer because they wonder, 'What has that animal done in the house?' Also, some people really don't like dogs. The minute they walk in and see this big, old dog bowl, they immediately won't like the house."

The same rules hold true for smokers: Remove all ashtrays, clean all curtains and upholstery, and consider smoking outdoors while your home is on the market.

"Interestingly, next to the kitchen, the smelliest room in the house is actually the living room," Dana says. "That's typically the room that has the most fabric, so that is where odors get absorbed."

3. Old fixtures

Want buyers to roll their eyes? Leave old fixtures on your doors and cabinets.

"You need to change out old fixtures in your house," Goldwasser says. "New cabinet hardware and doorknobs will probably cost all of $400 or $500, but it makes a huge difference."

The same holds true for dated ceiling fans, light fixtures and kitchen appliances.

"Homes that have old fans, lights, ovens, microwaves, ranges and dishwashers can really turn a buyer off," says Goldwasser. "Sellers will say, 'Oh, the buyers can take care of that.' Well, yes they can, but it's going to impede you from getting the highest price possible for your home."

4. Wallpaper

Your grandmother may have had it in every bedroom. Your mom may have loved it as a room accent. But today's buyer wants no part of wallpaper.

"Wallpaper is a definite no-no," Dana says.

Wallpaper is a pain to remove and simply adds another chore to a buyer's to-do list, Dana says.

"Wallpaper is extremely personalized. You've spent hours looking over books to pick out the wallpaper you want," she says. "What are the odds that the person walking in the door will also like that wallpaper that you picked out?"

5. Popcorn acoustic ceilings

Times change, and with them home decor styles. Acoustic popcorn ceilings, once the must-have for fashionable homes in the '60s and '70s, now badly date your space.

If you can't stomach the cost or the mess to remove the overhead popcorn, be prepared to credit a buyer in certain markets in order to close a sale.

"The popcorn acoustic ceiling is a major, major turnoff to buyers these days," says Goldwasser.

6. Too many personal items

Psychologically, when buyers tour a home, they're trying it on to see how it fits, just as they would a skirt or a pair of pants. If your house is cluttered with too many personal items, it's like the buyer is trying on those clothes with you still in them. A fit is unlikely.

"Anything that makes your house scream 'you' is what you don't want," Dana says. "I tell all my clients that how we decorate to live and how we decorate to sell are different, and right now, we're decorating to sell."

Sellers should try to eliminate personal items, including family photos, personal effects and even unique colors, she says.

"As soon as you have family photos, buyers get very distracted. 'Oh, did I go to school with him? What do their children look like?'" she says. "Suddenly, you're selling your family, and you're not selling the home."

If you really want to hook a buyer, Dana offers a tip: "I try to place a mirror strategically so that people can actually see themselves in the home, so they can actually picture themselves living there."

7. Snoopy sellers
Realtors and buyers alike generally bristle when the seller greets them at the door for a showing.

"It's so annoying," Goldwasser says. "They will want to walk around with the potential buyer and put in theirand two cents' worth. It's not good. Normally, there are one out of 10 sellers where it's OK to have them there, and that's because they know what is up with the property and how everything works."
"I tell all my clients that how we decorate to live and how we decorate to sell are different."

Goldwasser makes a point to shoo his sellers away from showings when he's the listing agent.

"They like to think they know what they're doing, and that's fine," he says. "But when you've sold thousands of homes and you have a system, you know how to get people the maximum value for their home. That's why they hire you, right?"

8. Misrepresenting your home

Misrepresenting your house online in the multiple listing service is a sure way to really upset buyers and their Realtors.

One of Cannon's buyers loved a home she saw online. When he drove by to take a look, he was surprised to find acres of ramshackle mobile homes across the street.

"Sellers are going to paint the best picture they can," he says. "Some listings I've looked at and wondered how in the world they got that gorgeous photo without showing all the junk that's around it. When you get there, you wonder why didn't they just be upfront?"

9. Poor curb appeal

Much is made of curb appeal, and for good reason: It's your home's handshake, the critical first impression that lasts with most buyers.

"You have to totally trim and edge your yard to get it into the most immaculate condition you can," Goldwasser says. "It's a big mistake to not freshly mulch the beds and trim the trees. Every little detail counts.

"To not power-wash the exterior or leave mud dauber and wasp and bird's nests in your eaves and above your doors? You've got to be a fool to do that."

10. Clutter

Whether inside or out, less is more when it comes to clutter.

"I usually start in the closets," Dana says. "Your closets should be half-full with nothing on the floor. Why? Because most people looking for a house have outgrown their previous house. Showing them that you've still got room to grow gives them a reason to buy."

Kitchens and built-in bookshelves should showcase spaciousness by following the rule of three. For kitchens, there should be no more than three countertop appliances. Meanwhile, bookshelves should be divided into thirds: one-third books, one-third vases and pictures, and one-third empty.

The home office should be very generic so any type of professional can imagine living there, Dana says.

"Otherwise, it can be a distraction: 'What does he do for a living? How much money does he make?'" she says.

Dana's tip for toddler parents is to pack away extraneous "kiddie litter" and keep a laundry basket handy.

"When you get that phone call one hour before a showing, toss everything in that basket and take it to the car with you and your kids, and you're all set," she says.

Law Requiring Water-Conserving Plumbing Fixtures Goes into Effect -- updated 3/25/14


AlfonsoGomezBroker.com - A law calling for the replacement of older plumbing fixtures with water-conserving ones went into effect on this year. The law says that, as of January 1, 2014, when improving a property new water-conserving toilets, showerheads, faucets and urinals must be installed before the local building department will issue a certificate of final completion and occupancy. The plumbing fixtures that will need to be replaced are: any toilet manufactured to use more than 1.6 gallons per flush; any showerhead manufactured to have a flow capacity of more than 2.5 gallons of water per minute; any interior faucet that emits more than 2.2 gallons of water per minute and any urinal manufactured to use more than one gallon of water per flush. Homeowners with questions about their individual fixtures are urged to contact the manufacturers.

How to Keep Your Dog Out of Your Garden

Is your pooch pawing your petunias? Here’s how to keep your dog out of your garden and away from your precious plants.
We want our dogs to eat well, but we don’t want them snacking on our heirloom vegetables and prized perennials. Nor do we want them digging up the daffodils.
How can you keep dogs from wrecking your garden?

Spray nasty odors


Your vegetable garden is a salad bar for your dog. To keep him away, spray plants with pungent white vinegar or apple bitter. Or plant marigolds between vegetable rows, which repel dogs and other backyard pests, such as Mexican bean beetles, aphids, squash bugs, and whiteflies.

However, don’t apply rabbit or deer repellents that contain coyote urine. Dogs love the smell of urine and will either roll in your sprayed plants or leave an odor of their own.

Sprinkle yucky tastes

Sprinkle powdered mustard or red pepper flakes around your plants. A few sniffs and licks of these unpleasant tastes will discourage your dog from returning to the area.

Fence dogs in or out

If you’ve got small dogs, a 16-inch fence border ($29 for 6 ft.) will mark the perimeter of your garden and discourage them from trampling your seedlings. For large, spunky dogs, encase your vegetables in a chicken wire cage with a top enclosure, which fence out deer and rabbits, too.

Or, contain your dog in a fenced play area that’s roomy and filled with interesting toys and treats. However, if your dog likes burying things, don’t give him a bone; instead offer chews, such as rawhide or bully sticks, that’ll keep him occupied and his mind off burying.

Erect prickly barriers

Place pruned rose or holly branches around your garden or plants. The thorns and prickly leaves will discourage your dog from entering the restricted area.
Provide a pooch path
If your dog cruises through your garden but leaves the veggies alone, make him a path of his own. You can lay down mulch, or even place a spare piece of carpet along your pet's favorite route. You may have to alter your garden design a bit, but that's better than watching puppy crash through your flowers or zucchini.

Bathrooms were the most common type of remodeling job in 2013, according to the National Association of Home Builder’s (NAHB) Remodeling Market Index. Bathroom remodeling was cited as the most common job during 2013 by 72 percent of remodelers, followed by kitchen remodeling at 70 percent.

In the beginning of 2014 inventory of homes remained low but now in spring, and going into summer, home sellers are coming out in force. Home prices will continue to stay strong and will remain at their current rate or plateau. Home seller don't allow yourself to get caught in the mind trap of, "I'm going to wait for the market to max out..." there is no magic ball. If you ever thought of selling you seriously need to consider now because homes are still selling fast and their are a healthy amount of buyers. Home price will remain strong through the summer of 2014. BUT DON'T FORGET, WHAT GOES UP MUST COME DOWN... Eventually...

City of Diamond Bar "Report for Reward" program offers a financial incentive...


In the City of Diamond Bar, a recent program was established to reward those who provide information leading to the identification and arrest of any person who willfully damages or destroys any real or personal property.   The “Report for Reward” program went into effect on November 15, 2013 after the Diamond Bar City Council enacted Municipal Code Section 9.02.010 on October 1, 2013.

According to city documents, the Report for Reward program was developed as a way to combat residential and vehicular burglaries within the city limits.  The program offers a financial incentive of up to $500.00 for information leading to the arrest of person(s) suspected of committing these crimes.  To be eligible for the Report for Reward program, the person must call the Walnut/Diamond Bar Sheriff station at (909)595-2264 (or 9-1-1 if the crime is in progress) and provide information leading to the arrest of a person suspected of damaging personal property as a result of committing or attempting to commit a residential or vehicular burglary.

The Report for Reward program produced immediate results as four residents were awarded $500.00 each at the December 17, 2013, Diamond Bar City Council meeting.

AlfonsoGomezBroker.com - The #1 question I get from home sellers is "what is my house worth?" and once I give them the answer, the reply is typically, "WHAT..." Finding the value of your home is an art not a science. Just because your neighbor sold their home for, for example, 500k doesn't mean your home is worth the same. In order for a home to be comparable to yours the home must be: #1-within approximately 1 miles from yours, #2-1 bedroom bigger or smaller than yours, and #3-within 100 square feet bigger or smaller than yours. On top of these 3 things, there are other factor such as upgrades, condition of home, additions, etc. Then I will typically hear, "well, the online site told me my home is worth..." The online sites acknowledge that the free home values are typically off by 6 to 10%. Their information is outdated and not valid.
